Terms of Service — TrimCall

1. Agreement

These Terms govern your use of TrimCall, a service of SUKI & CO VENTURES LLC (“TrimCall,” “we,” “us”). By creating an account or using TrimCall, you agree to these Terms on behalf of yourself and your business (“you”).

2. The service

TrimCall provides an AI receptionist that answers phone calls, books and manages appointments, sends text messages, and collects deposits on your behalf, based on the information and settings you provide.

3. Eligibility and accounts

TrimCall is for business use. You must be at least 18 and authorized to act for your business. You are responsible for keeping your account secure and for all activity under it.

4. Pilots and free trials

Pilot and trial access is provided free of charge for the stated period, as is, and may change or end at any time. We may ask for feedback, which we may use to improve TrimCall without obligation to you.

5. Plans, fees, and usage

Paid plans are billed monthly in advance through our payment provider and include set usage allowances. Usage beyond your allowance may be billed at the published overage rates or may require an upgrade. Fees are non-refundable except where required by law. We may change prices with at least 30 days’ notice.

6. Deposits and payments from your clients

If you enable deposits or no-show fees, payments are processed through our payment provider under its terms and paid out to your connected account. You set your deposit and cancellation policies and are responsible for communicating them and handling refunds and disputes.

7. Your responsibilities

• Provide accurate information about your services, prices, hours, and policies, and keep it up to date.

• Obtain any consent required to contact your clients by text message, and honor opt-outs.

• Use TrimCall in compliance with all applicable laws, including laws on call recording, telemarketing, and text messaging.

• Review bookings and messages TrimCall sends to you, and respond to approval requests and escalations.

• Not use TrimCall for unlawful, harmful, or deceptive purposes, or to send unsolicited marketing.

8. AI limitations

TrimCall uses artificial intelligence and may occasionally misunderstand callers, give incomplete answers, or make scheduling errors. It is not a substitute for your professional judgment. You remain responsible for your business decisions, your services, and your relationships with your clients.

9. Your data

You own the data you and your clients provide. You grant us permission to use it to provide, maintain, and improve TrimCall, as described in our Privacy Policy. We act on your behalf when we handle your clients’ information.

10. Our property

TrimCall, its software, and its content belong to us and our licensors. You may not copy, resell, reverse engineer, or build a competing product from TrimCall.

11. Suspension and termination

You may cancel anytime; cancellation takes effect at the end of your billing period. We may suspend or terminate access if you violate these Terms, fail to pay, or create risk to TrimCall or others. After termination, we delete your data as described in our Privacy Policy.

12. Disclaimers

TrimCall is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that TrimCall will be uninterrupted, error-free, or that every call will be answered or booked correctly.

13. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or bookings. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

14. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of TrimCall, your services, your violation of these Terms, or your violation of any law or third-party right, including messaging and consent laws.

15. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in Travis County, Texas.

16. Changes

We may update these Terms and will notify you of material changes by email or in the product. Continued use after changes take effect means you accept them.
